Terms & Conditions

Please read all the terms and conditions below carefully.
By making a booking with Pendulums you are
agreeing to all the terms and conditions stated below.
Booking policy
· each booking accounts for one (1) participant only, please make separate bookings if you are booking for more than one (1) participant.
· all bookings are handled on a first come, first serve basis.
· to ensure the comfort, health and safety of all, the maximum capacity stated for each event/workshop is strictly observed.
ü bookings exceeding the maximum capacity will automatically be placed on a waitlist.
· a non-refundable deposit amounting to approximately 50% is required upon booking to secure your space.
· the balance should be paid in full fifteen (15) days prior to the event/workshop start date.
· in the event the payment of the balance is not received in full fifteen (15) days prior to the event/workshop start date, Pendulums reserves the right to assume non-participation and offer the space to another participant.
ü in this case, the deposit paid upon booking will be forfeited.
· the deposit paid upon booking is non-refundable, but may be rolled over to subsequent events/workshops under special circumstances upon case by case consideration. Any cancellation by you must be notified to the Pendulums in writing for case by case consideration.
· for virtual events, payment in full is required upon booking for your space to be confirmed.
· If the event, Pendulums is unable to accept your booking for any reasons whatsoever, a written confirmation of such cancellation will be issued together with the refund of any payment(s) made by you.
· If circumstances force you to leave the event/workshop early, you hereby agree to make all the necessary arrangements at your own costs and expenses. You shall not be entitled to any refund of the event/workshop Fee in any manner whatsoever. Further, in such circumstances, you irrevocably agree to hold harmless and release the Organiser from any and all liabilities in respect of any losses, damages, expenses, claims, delay etc arising thereof and/or in connection thereto.
Cancellation policy
Participant cancellation
policy
· payments are eligible for refunds if cancellation is made sixty one (61) days or more prior to the event/workshop start date, with the exception of:
ü the non-refundable deposit upon booking;
ü RM100 administrative fee.
· payments are strictly not refundable if cancellation is made sixty (60) days or less prior to the event/workshop start date.
· refunds are not available for any reason including, but not limited to:
ü health conditions;
ü medical, personal, family, or work emergencies;
ü weather;
ü natural disaster;
ü acts of terrorism;
ü airline cancellations or delays, missed flights, or other transportation issues;
ü change of mind.
· the deposit paid upon booking is non-refundable, but may be rolled over to subsequent events/workshops under special circumstances upon case by case consideration. Such requests by you must be notified to Pendulums in writing for case by case consideration.
· for virtual events, all payments are strictly non-refundable.
Instructor cancellation
policy
· participants will be fully refunded, with the exception of the non-refundable deposit upon booking which may be rolled over to subsequent events/workshops, should the instructor(s) need to be absent from the event/workshop for any reason including, but not limited to:
ü health conditions;
ü medical, personal, family, or work emergencies;
ü weather;
ü natural disaster;
ü acts of terrorism;
ü airline cancellations or delays, missed flights, or other transportation issues;
ü change of mind.
· for virtual events/workshops, participants will be fully refunded.
Management cancellation
policy
· Pendulums reserves the right to postpone the event/workshop if:
ü minimum sign ups are not reached thirty (30) days prior to the event/workshop start date;
ü rules are enacted prior to the event/workshop start date so that the event/workshop is prohibited from being carried out, or travelling to the event/workshop venue is prohibited;
ü prior to the event/workshop start date, the health and safety of participants are deemed challenged in the event the event/workshop is being carried out.
· in the event the event/workshop is postponed,
ü participants will be fully refunded, with the exception of the non-refundable deposit upon booking which may be rolled over to subsequent events/workshops, constituting a full settlement;
ü any additional transportation, accommodation or travel expenses incurred will not be reimbursed.
ü for virtual events/workshops, participants will be fully refunded.
Disclaimers (general)
· the total price paid for one (1) event/workshop package accounts for one (1) space on the event/workshop, which covers the inclusions detailed in the event/workshop description, such as:
ü stay (where applicable);
ü meals;
ü classes;
ü activities.
· insurance is not included in the event/workshop package, but highly recommended for ultimate protection.
· sponsored items are free, and are not included in the total price of the event/workshop
· requests for a partial or total refund for not receiving the sponsored items will not be entertained.
· Pendulums is not responsible for damaged, lost, stolen or missing:
ü personal items;
ü sponsored items.
· Pendulums is not responsible for any transportation issues prior to the event/workshop that may delay arrival or result in non-participation, which include, but are not limited to:
ü airline cancellations or delays;
ü missed flights;
ü other transportation issues.
· you must sign and return the liability waiver and event/workshop contract prior to the commencement of the event/workshop.
· photography and filming will be carried out during the event/workshop.
ü the intended use of these materials for Pendulums and/or the collaborator(s) may include, but are not limited to:
Ø advertising;
Ø marketing;
Ø fundraising;
Ø promotional purposes.
ü upon participating, you agree for Pendulums and/or the collaborator(s) to collect and use these materials of you in any public media including, but not limited to:
Ø internet;
Ø radio;
Ø television;
Ø print.
ü upon participating, you acknowledge that the consent is being given solely for the benefit of Pendulums and/or the collaborator(s), without expecting any form of compensation or benefit from the use of these materials.
All participants are required to behave appropriately and to treat the other participants, the Organiser, its agents and volunteers at the Retreat with dignity and respect. You acknowledge that we reserve the right to remove and require you to leave the Retreat if we, in our sole discretion, consider your presence, acts, omission and/ or behaviour to create a disruption or to hinder the Retreat and/or the enjoyment of the Retreat by other persons in attendance. In such circumstance, you irrevocably agree to hold harmless and release the Organiser from any and all liabilities in respect of any losses, damages, expenses, claims, delay etc arising thereof and/or in connection thereto.
Disclaimers (overnight stay)
· each booking accounts for one (1) participant only, please make separate bookings if you are booking for more than one (1) participant.
· all rooms and bedding are allocated on a first come, first serve basis.
· should you have any requests for your stay, kindly specify upon booking.
ü while we aim to accommodate these requests to our best abilities, we cannot guarantee that all requests will be fulfilled.
· room size and amenities may vary slightly from the pictures displayed.
· if you do not specify who your roommate(s) is/are upon booking, Pendulums reserves the right to assume you are open to sharing the room with any participant(s).
ü please select “female”, “male” or “either” upon booking to give us an idea of which gender you will be comfortable sharing with.
· if you are booking a shared bed, you must specify a roommate who is also booking a shared bed.
ü if you do not specify, Pendulums will assign another participant to share the bed with you.
ü please select “female”, “male” or “either” upon booking to give us an idea of which gender you will be comfortable sharing with.
ü due to covid-19 considerations, bed sharing option is only applicable if you are sharing the bed with your friend or family member.
ü if a booking is not received from the participant you specify within seven (7) days of receiving your successful booking, Pendulums will allocate the next available non-sharing bedding option to you.
Disclaimers (virtual events)
· the booking window may differ between events – please visit the individual event page to find out more.
ü bookings received outside the booking window will not be entertained.
· Pendulums will start checking you in ten (10) minutes before the start of the event.
ü please be punctual, Pendulums will stop checking you in as soon as the event commences.
· unless the technical difficulty arose from Pendulums, all payments are strictly not refundable.
Changes to the terms & conditions
· Pendulums reserves the right, at its sole discretion, to change, modify, add or remove any of the above terms & conditions at any time by posting the new terms and conditions on this page.
· changes to the above terms & conditions are effective when they are posted on this page.
· the effective date at the top of the terms & conditions will be updated upon posting the new terms and conditions on this page.
